Refund Policy & Cancellations
Note: Refunds are not available unless explicitly approved by the Northball Academy Directors.

Program Suspension Clause

Northball Academy reserves the right to temporarily suspend or cancel sessions due to unforeseen circumstances, including but not limited to:
• Facility issues (e.g., power outages, safety concerns)
• Staffing shortages
• Severe weather conditions
• Public health concerns or government mandates

In such cases, participants will be offered one of the following:

1. Rescheduled Sessions – Missed sessions may be rescheduled at the discretion of Northball Academy.

2. Credit for Future Programs – A credit may be issued equal to the value of the missed sessions.

3. Refund (if applicable) – If the program is suspended for more than three (3) consecutive weeks with no resumption plan, a pro-rated refund may be requested. Approval of such refunds is at the sole discretion of the Northball Academy Directors.

Northball Academy will communicate any program suspensions and next steps in a timely manner.

Code of Conduct & Program Policy

By registering for any Northball Academy programs, you acknowledge and agree to uphold a standard of respect toward all coaches, staff, and participants during training sessions. Aggressive, disruptive, or inappropriate behaviour will not be tolerated and may result in removal from the premises. In such cases, no refunds will be issued.

Concerns or grievances may be directed to a manager or designated program leader on-site. While children and youth enrolled in programming will not be denied participation, parents/guardians may be asked to wait in the foyer or outside the premises, depending on the circumstances.

Force Majeure Clause

Northball Academy shall not be liable for any delay, interruption, or cancellation of program services due to causes beyond its reasonable control, including but not limited to:
• Natural disasters (e.g., earthquakes, floods, storms)
• Fires, explosions, or accidents
• War, riots, or civil unrest
• Government actions, mandates, or restrictions
• Epidemics, pandemics, or public health emergencies

In such cases, Northball Academy will make reasonable efforts to offer alternative arrangements such as rescheduled sessions, virtual programs, or future credits. Refunds are not guaranteed and will only be considered at the sole discretion of the Northball Academy Directors if no reasonable alternatives can be provided.

Limitation of Liability

Participants and their families agree to indemnify and hold harmless Northball Academy and its affiliates, directors, officers, employees, agents, and representatives from any and all claims, demands, damages, liabilities, or expenses (including reasonable legal fees) arising from or related to their participation in the program, except in cases of gross negligence or intentional misconduct by Northball Academy.

Governing Law Clause

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Province of Ontario. Any disputes shall be resolved exclusively in the courts of Ontario.

Photography and Social Media Disclaimer

I acknowledge that Northball Academy may take photographs and/or videos of me or my child during participation in the program. I agree these may be used for promotional or educational purposes, including social media, brochures, websites, and marketing materials.

I release Northball Academy and its affiliates from any claims or liabilities arising from the use of these media. If I do not want photos or videos taken, I must notify staff in writing before the program begins.

I understand that other participants or spectators may take photos or videos and post them on social media. Northball Academy is not responsible for such postings and there is no expectation of privacy during participation.
